Counsel – Labor & Employment

Primary responsibilities of this attorney are labor and employment law counseling and litigation management for a nationwide company with a large, varied workforce, including door-to-door direct sellers, power plant workers (some unionized), office workers, etc. The attorney in this role provides day-to-day advice and counsel to Human Resources and business units on a broad range of matters, including advice on legal and business risks, recruiting, hiring, employee relations, discipline and terminations, internal investigations, leaves of absence, wage and hour compliance, and EEO compliance. In addition, the attorney assists in all aspects of employment litigation management including response to demand letters and administrative agency charges.

Responsibilities

  • Manage portfolio of employment law matters as assigned by Assistant General Counsel – Labor & Employment

  • Provide day-to-day counseling and strategic legal advice to business partners on labor and employment practices

  • Manage all aspects of local and state agency claims (e.g. EEOC, NLRB, OSHA and other federal and state agency matters) including drafting of position statements and mediating such claims as required

  • Advise Human Resources and management concerning employee relations, staffing strategies, benefits, performance management, severance programs, compensation and commission plans, wage and hour issues, leave management, workplace safety, EEO compliance, and internal investigations

  • Draft and review employment agreements, policies, restrictive covenants, and severance/settlement agreements

  • Oversee all aspects of matter management in employment litigation and immigration matters, including case strategy, selection and direction of outside counsel, investigation, discovery and budgeting

Preferred Qualifications

  • Strong communication skills, technical ability, and attention to detail

  • Ability to effectively, efficiently, and professionally manage multiple time-sensitive projects

  • Strong focus on problem-solving and business solutions

  • Ability to work independently and with a minimal amount of direction

  • Ability to successfully interact with others in the legal department and the company

  • California labor and employment experience preferred

Requirements

  • Strong academic credentials, including Juris Doctor degree from an ABA-accredited law school, and member of the bar of a U.S. jurisdiction

  • 4-7 years of labor and employment law experience working at a law firm or in-house legal department or as judicial clerk
