Counsel/Senior Counsel – Real Estate Litigation

The Legal Department is currently hybrid remote, but subject to any corporate changes. You will also be expected to be in the office for necessary legal meetings.

This position will provide legal support and advice to the Company on property disputes and real estate litigation matters and will manage potential and pending lawsuits and other disputes involving the Company. Additionally, this position will advise the Company regarding real estate transactions, property management, and operations, including management of legal issues around hydroelectric generating facilities. Candidate must have a background in real estate law and possess exceptional judgment in analyzing agreements, negotiating, and providing sound advice on a broad range of matters. This position will collaborate with outside counsel and employees at all levels within the Company to provide advice and guidance.

Job Responsibilities:

  • Effectively and efficiently manage pending and potential litigation involving the Company around property disputes, real estate claims and eminent domain.

  • Negotiate with opposing counsel on various real estate matters, including sales, leases, licenses, access agreements and associated real estate transactions.

  • Manage and direct outside counsel handling litigation, negotiations, and related matters on behalf of the Company.

  • Advise on property inquires for lands associated with Federal Energy Regulatory Commission regulated hydroelectric generation facilities.

  • Work closely with Litigation and Real Estate team to strategically advise the Company on real estate transactions, property management, operations, policies and procedures, and initiatives.

  • Assist with management of the legal budget, including oversight and approval of outside counsel spend.

  • Build constructive working relationships with internal business partners and outside legal counsel.

  • Identify opportunities to improve legal processes and operations.

Job Requirements:

  • Graduate of an American Bar Association accredited law school with at least an L.L.B. or J.D. degree.

  • Licensed to practice law in one or more states in which the company or its subsidiaries operate.

  • Minimum of 4 years of real estate experience as in-house counsel and/or in private practice, including significant experience litigating real estate and property disputes.

  • Experience with a variety of real estate matters such as acquisitions, sales, leases, licenses, easements, condemnations, title and survey review, and other due diligence items.

  • FERC or hydroelectric generation experience is preferred.

  • Knowledge of relevant utility statues, regulations, and guidance documents related to the business preferred.

  • Ability to quickly assess risks and communicate complex information in a simple and timely manner.

  • Ability to establish and build relationships with internal and external partners to maximize effectiveness.

  • Demonstrated ability to manage multiple projects with competing deadlines.

  • Strong focus on inclusion, innovative thinking, practical solutions, and providing excellent customer service.
